1. Agreement to Terms

By accessing and using ehchildcare.co.uk ("the Platform"), operated by E and H childcare ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Platform.

2. Description of Service

E and H childcare provides an online platform that connects parents and guardians ("Parents") with babysitters and childcare providers ("Babysitters"). We facilitate:

• Profile creation and browsing for both Parents and Babysitters
• Booking and scheduling of childcare services
• Secure payment processing
• Review and rating systems
• Communication between Parents and Babysitters

Important: We act as an intermediary platform only. We do not employ Babysitters and are not responsible for the actual provision of childcare services.

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain the security of your account credentials

4. User Accounts

4.1 Registration

You must create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Types

Parent Accounts: Parents are responsible for ensuring the accuracy of booking details, payment information, and communication with Babysitters.

Babysitter Accounts: Babysitters must provide accurate qualifications, certifications, experience, and availability. You represent that all information provided is truthful and current.

5. Babysitter Verification

While we encourage Babysitters to obtain and display relevant certifications (DBS checks, first aid certification, qualifications), we do not verify these credentials ourselves. Parents are responsible for conducting their own due diligence before booking any Babysitter.

We reserve the right to request verification documents and may suspend or terminate accounts that fail to provide requested information.

6. Bookings and Cancellations

6.1 Booking Process

• Parents can request bookings through the Platform
• Babysitters have the right to accept or decline any booking
• A booking is confirmed only when accepted by the Babysitter and payment is processed

6.2 Cancellation Policy

By Parents:

• Cancellations more than 48 hours before the scheduled time: Full refund minus processing fees
• Cancellations 24-48 hours before: 50% refund
• Cancellations less than 24 hours before: No refund

By Babysitters:

• Must provide as much notice as possible
• Repeated last-minute cancellations may result in account suspension
• Parents receive full refunds for Babysitter-initiated cancellations

7. Payments and Fees

7.1 Payment Processing

All payments are processed securely through our third-party payment processor (Stripe). By making a payment, you agree to their terms of service.

7.2 Platform Fees

We charge a service fee on each booking, which is clearly displayed before payment. This fee covers:

• Platform maintenance and development
• Customer support
• Payment processing
• Insurance and security measures

7.3 Babysitter Payments

Babysitters are paid directly through Stripe Connect. Payments are typically transferred within 2-7 business days after the booking is completed.

7.4 No Offline Transactions

All payments must be processed through the Platform. Arranging payments outside the Platform is prohibited and may result in account termination.

8. User Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate any person or entity
• Harass, abuse, or harm another person
• Use the Platform for any illegal purpose
• Circumvent the Platform to arrange direct payments
• Copy, modify, or distribute Platform content without permission
• Interfere with the Platform's operation or security
• Upload viruses or malicious code
• Scrape or data mine the Platform

9. Reviews and Ratings

• Parents can leave reviews after completed bookings
• Reviews must be honest, fair, and based on actual experience
• We reserve the right to remove reviews that violate our policies
• Fake or incentivized reviews are prohibited
• You may not review your own services using alternate accounts

10. Child Safety

Child safety is paramount. Parents remain responsible for:

• Vetting and selecting appropriate Babysitters
• Providing necessary information about their children
• Ensuring their home environment is safe
• Maintaining appropriate supervision arrangements

Babysitters are responsible for:

• Providing appropriate care and supervision
• Following all instructions provided by Parents
• Acting in the best interests of the children at all times
• Reporting any concerns or incidents to Parents immediately

11. Liability and Disclaimers

11.1 Platform Liability

E and H childcare acts solely as an intermediary platform. We are not liable for:

• The quality, safety, or legality of services provided by Babysitters
• The accuracy of user profiles or representations
• Any disputes between Parents and Babysitters
• Any injuries, losses, or damages arising from childcare services
• Failed or interrupted services due to technical issues

11.2 No Warranty

The Platform is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That the Platform is free from viruses or harmful components
• The availability of suitable Babysitters

11.3 Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the amount of fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Insurance

While we encourage all Babysitters to maintain appropriate insurance coverage, we do not provide insurance for childcare services. Parents and Babysitters are responsible for their own insurance arrangements.

13. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is owned by E and H childcare or our licensors and is protected by copyright and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works without permission
• Use our trademarks or branding without authorization
• Remove or alter any copyright notices

14. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with UK GDPR.

15. Termination

15.1 By You

You may close your account at any time by contacting us. Closure does not affect any outstanding obligations.

15.2 By Us

We may suspend or terminate your account immediately if you:

• Breach these Terms and Conditions
• Engage in fraudulent or illegal activity
• Pose a risk to children or other users
• Damage our reputation or business

16. Dispute Resolution

If you have a complaint or dispute:

1. Contact us first at info@ehchildcare.co.uk
2. We will attempt to resolve the matter within 14 days
3. If unresolved, disputes between Parents and Babysitters should be settled directly

17. Indemnification

You agree to indemnify and hold harmless E and H childcare, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Platform
• Your breach of these Terms
• Your violation of any rights of another person
• Your provision or receipt of childcare services

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use after changes constitutes acceptance of the modified Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and E and H childcare regarding the use of the Platform.
